Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services offered by Seapix AI (“Seapix,” “we,” “us,” or “our”), including AI-assisted video and image generation, account features, and related functionality (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

1. Eligibility

You must be at least the age of majority in your jurisdiction (and in any event at least 13 years old) to use the Services. If you are between 13 and the age of majority, you may use the Services only with the consent of a parent or legal guardian. You may not use the Services if you are barred from doing so under applicable law.

2. Accounts

You may need an account to access certain features. You are responsible for safeguarding your credentials and for all activity under your account. You must provide accurate information and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose security or legal risk.

3. The Services

The Services allow you to submit text prompts, images, audio, and other inputs to generate video, images, or related outputs using third-party and proprietary AI systems. Features, models, quality, availability, and latency may change without notice. We do not guarantee uninterrupted or error-free operation.

4. Credits, payments, and subscriptions

Certain features consume credits or require payment. Prices, credit packs, renewal options, and taxes (if any) are presented at checkout. Unless expressly stated otherwise, fees are non-refundable except where required by law or as described in our refund policy at the time of purchase. Credits may expire or be forfeited if your account is terminated for cause. You authorize us and our payment partners to charge your selected payment method for purchases you confirm.

5. Acceptable use

You agree not to use the Services to:

  • Violate any law or regulation, or infringe others’ intellectual property, privacy, publicity, or other rights;
  • Generate, upload, request, solicit, or distribute sexually explicit, pornographic, or NSFW sexual content, including (without limitation) content intended primarily for sexual arousal or gratification, depictions of sexual acts, or sexualized nudity—whether in prompts, reference uploads, or outputs;
  • Generate, upload, or distribute content that is illegal, fraudulent, hateful, harassing, violent, sexually exploitative of minors, or otherwise harmful;
  • Impersonate any person or entity, or misrepresent the origin of content;
  • Attempt to probe, scan, or test the vulnerability of our systems, or bypass access controls, rate limits, billing, or content-safety screening;
  • Reverse engineer, decompile, or extract models or software except where permitted by law;
  • Resell or redistribute the Services in a way that competes with Seapix without written permission.

We may investigate and remove content, suspend jobs, or terminate access for violations. We may also use automated or manual review—including third-party moderation services—to enforce safety and compliance.

A more detailed description of disallowed content, safety expectations, and moderation for AI generation is set out in our Acceptable Use Policy, which is incorporated into these Terms by reference.

6. Content moderation and processor requirements

Where payments are processed by a Merchant of Record or payment partner (for example, Creem), you acknowledge that AI image and AI video generation must not be used to create sexually explicit, pornographic, or prohibited NSFW content, and that we are required to operate controls consistent with that partner’s content-safety and moderation rules.

Under Creem’s rules, merchants operating AI image or video generation products are required to screen user-supplied text prompts using Creem’s Content Moderation API before those prompts are sent to a generation model. See Creem’s Content Moderation API documentation. Creem has communicated that this is a strict requirement from May 1, 2026 for merchants in scope. Related expectations appear in Creem’s content safety and moderation requirements for account reviews. Seapix will comply with these processor requirements as they apply to our Services and checkout flows.

You must not attempt to circumvent any prompt screening, moderation, or safety controls that we or our payment partners apply (including automated decisions you disagree with).

7. Intellectual property and your content

You retain ownership of inputs you submit, subject to licenses you grant below. Seapix and its licensors own the Services, including software, branding, and documentation. Subject to these Terms and applicable law, we grant you a non-exclusive, non-transferable license to use outputs you lawfully generate through the Services for your personal or internal business purposes, in accordance with any usage rules shown at the time of generation and any additional restrictions imposed by upstream model providers.

You grant Seapix a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your inputs and related data solely as needed to provide, secure, and improve the Services, comply with law, and enforce these Terms.

AI outputs may not be unique and may resemble third-party works. You are responsible for ensuring your use of outputs complies with law and third-party rights. We do not warrant that any output is free of third-party claims.

8. Third-party services

The Services rely on infrastructure and model providers (for example, cloud APIs). Their terms and policies may apply to your use. We are not responsible for third-party services or for outages or actions outside our reasonable control.

9. Disclaimers

THE SERVICES AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEAPIX DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, SAFE, OR SUITABLE FOR ANY PURPOSE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEAPIX AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SEAPIX FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE PROHIBITED BY LAW.

11. Indemnity

You will defend, indemnify, and hold harmless Seapix and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your inputs, your use of outputs, your violation of these Terms, or your violation of third-party rights.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if we must comply with law, or for operational reasons. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive termination.

13. Governing law and disputes

These Terms are governed by the laws applicable to Seapix’s operating jurisdiction, without regard to conflict-of-law principles. Courts in that jurisdiction shall have exclusive jurisdiction over disputes, unless mandatory consumer protections in your country require otherwise.

14. Changes

We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. If changes are material, we may provide additional notice. Continued use after the effective date constitutes acceptance of the revised Terms, where permitted by law.

15. General

These Terms constitute the entire agreement between you and Seapix regarding the Services and supersede prior agreements on this subject. If any provision is held invalid, the remainder remains in effect. Our failure to enforce a provision is not a waiver.
